Mucheche Labour Law in Zimbabwe updates: In Tererai Louis Mutasa v ZESA Enterprises ( Pvt) Ltd SC 88/24, the Supreme Court of Zimbabwe decided that an employer is not legally allowed to discipline an employee for a misconduct committed under an expired fixed term contract. This case is distinguishable from the other Supreme Court judgment in Muchechetere v Zimbabwe Broadcasting Corporation (Pvt) Ltd SC 143/21 in which the Supreme Court ruled that the employer had a legal right to discipline an employee for misconduct committed under an expired fixed term contract because of prompt of renewal of the fixed term contract on the same terms and conditions and continuity of the employment relationship without cessation or stoppage after the employee’s old fixed term contract of employment expired- Commercial and Labour Lawyer Caleb Mucheche.
